Tameside - LNL consultation launched

2013

Tameside Metropolitan Borough Council (Tameside) is the latest council to launch a consultation into the possible adoption of a Late Night Levy (LNL).

Although it is their proposal to exempt New Years Eve, the Levy will apply to all premises licensed for the sale of alcohol between 00:01 - 06:00 daily for all other days of the year. The relevant legislation specifies a number of categories of premises which may be exempt from the Levy such as Bingo Halls, Hotels and 'Country Village Pubs'; in this instance Tameside does not propose to exempt any such premises:

Tameside Late Night Levy Consultation - 2013

The Council is not proposing to exempt any premises from paying the levy because we consider that all late night licensed premises do to some extent, whether directly or indirectly, contribute towards the need to police the late night economy. The Council is, however, proposing to exempt those premises which are licensed to supply alcohol during the late night supply period on New Years Eve only.

There is a requirement in the legislation that a minimum of 70% of the net income from the levy be apportioned to Greater Manchester Police whilst Tameside can retain up to 30% of the net income to spend on measures to reduce or prevent crime and disorder, promote public safety, reduce or prevent public nuisance, and/or the cleaning of streets.

Tameside is proposing that rather than see the levy revenue split between two separate programmes, it is their intention to reach agreement with the Police and Crime Commissioner to develop a single programme delivered in partnership between Tameside, the Police and licensees, to decide how the money is spent."

The consultation which can be found HERE commenced on Tuesday 13th August 2013 and runs until Tuesday 5th November 2013. If approved, the Levy will come into affect at a later date which is yet to be published.

ffected operators would be well advised to engage in the consultation process.
