Scotland - Dundee: Overprovision for the whole City...except the waterfront

01 Sep
2014

Further to our previous article in April ('Dundee overprovision for the Whole City') which notified that the Dundee City Licensing Board had commenced a consultation exercise seeking views as to the areas within which an overprovision policy should apply, the Licensing Board has agreed to a formal statement that there is an overprovision of licensed premises - except in the Waterfront area.

The new policy, which will be adopted by October 2014, means that in future any operator applying to the Board for a licence will need to overcome the rebuttable presumption that the application should be refused on the basis of overprovision.

The decision to introduce the policy resulted in a large number of applications before the Board in August being continued to its meeting on 9 October 2014, when the policy will have been published.

The Board will review the position in one year's time.

Law correct at the date of publication.
