Change To The Law of Tobacco Sales

Most of you will be aware that from 1 October 2007, it is unlawful to sell tobacco products to persons aged under 18 years. Previously the law prevented sales to under 16’s, but the threshold has been raised by the The Children and Young Persons (Sale of Tobacco etc.) Order 2007.
It has been law that premises retailing cigarettes and tobacco, including tobacco vending machines should display the correct warning notice. These notices should now be amended to take account of the new age limit of 18 years.
Vending machines must display a sign stating ‘This machine is only for the use of people aged 18 or over’. The sign must be at least 60mm x 100mm, with letters at least 6mm high, and must be clearly visible to anyone using the machine.
Selling or allowing the sale of tobacco products to someone under the legal age can result in a fine of up to £2,500. Failing to display the statutory notice can result in a fine of up to £1,000. This applies both to over the counter and vending machine sales.
Under age test purchasing for tobacco is known to be carried out in many areas. Staff should all be aware of the change to the law, and the policies concerning tobacco sales which apply at their premises. It is a good opportunity to make sure all of your staff training is up to date. Additionally, all signage should be checked to make sure it has been updated and complies with the legislation.
