Anti-Social Behaviour Orders

These are available as an alternative to an Exclusion Order. The effectiveness of Exclusion Orders is restricted. They are only available from a Magistrates Court if a customer is convicted of an offence on licensed premises that involves violence or a threat of violence Please refer to our separate bulletin available either on request or on our website.

Anti-Social Behaviour Orders were introduced by the Crime and Disorder Act 1 998 which came into force on 1st April 1999. They were not aimed specifically at use by licensed premises but can be used to prohibit a person visiting the licensed premises specified in an Order.

The Home Office Guidance document in relation to the Orders explains:- "The Anti-Social Behaviour Order is a community based Order akin to an injunction. It can be applied for by the Police or Local Authority against an individual who acts in an anti-social manner - that is, a manner which causes harassment, alarm or distress to one or more people in the different household to the Defendant."
