Rank Overpaid VAT on Bingo

The European Court of Justice (‘ECJ’) yesterday backed Ranks claims that it overpaid VAT on bingo and amusement machines. Rank has been at loggerheads with the UK tax authorities for a number of years winning various court cases in the UK.  Following an appeal by HMRC, the ECJ has now backed Ranks stance for bingo claims totalling £253.4m including interest. The ECJ confirmed that UK VAT law was in breach of the EU law principle of fiscal neutrality.

Rank is now considering the implications of the ECJ decision with its advisors on its amusement machines claim for £30.8m including interest and will provide an update on this claim in due course.
