Scotland - Tobacco and Primary Medical Services (Scotland) Act 2010

This Bill was passed into law on 27th January 2010 and has yet to be brought into force.
Amongst its provisions are included a prohibition on the display of tobacco products or smoking related products in a place where such products are offered for sale. This excludes a display in a specialist tobacconists, subject to restrictions or indeed to any wholesale operation supplying to other retailers.
It also makes it an offence to sell tobacco products to persons under the age of 18 (bringing the law into line with England and Wales) with the possibility of a defence of due diligence. Vending machines for the sale of tobacco products will be outlawed.
Once the relevant provisions have been brought into effect, there is a requirement that a Council must, at least once in every period of 12 months, carry out a programme of enforcement action in its area to ensure compliance with the new law.
The Act only applies to Scotland.
