REGULATORY OFFENCES, REVIEWS AND CLOSURE ORDERS

A feature of the Licensing Act 2003 is its increased accountability on those in the licensed industry.

Licensing Authorities, Police, and Trading Standards are making unannounced visits and test purchases on an increasing frequency. Instant fines, interviews under caution and prosecutions are becoming more familiar, and it is vitally important that all staff are aware of their responsibilities.

Closure orders are issued by the Police and can have far reaching consequences. We recommend that you always seek immediate advice if you are served with a closure order as there is a requirement for any closure order to come before the Licensing Authority to consider the question of whether the licence should be revoked.

Applications for review of premises licences can be made by any of the Authorities or neighbouring residents at any time. If you hold a licence and believe that a review application is likely, or if you are contemplating applying for a review of a licence in the vicinity of your home, then please call us to discuss your requirements.
