Scottish Licences are subject to a mandatory condition that no irresponsible drinks promotions can be carried out. If your offer solely relates to food pricing then this would be lawful, however if the offer relates to alcohol being provided free of charge or at a reduced price then you would be in breach of the mandatory condition which could lead to prosecution.
The law requires you to operate to the terms of your operating plan which specifies the times the premises will be open, therefore you are under a duty to trade, however, temporary changes from those hours are permitted if it is as a result of, say, illness or bad weather.
It is possible that your operating plan may require amendment and we would ask you to talk to us in more detail.
